Batsman is Out or Not Out in this case ?

First picture: Out. The middle stump is completely out of the ground, which suffices to put the wicket down even though the bails remain on top of the remaining two stumps.
Second picture: Not out. The bails are still in place, and none of the stumps are completely out of the ground.
All of the above assumes that the wicket has been legitimately struck by the ball, fielder with ball in hand, etc etc.

So this goes by second part of the statement- "The wicket is put down if a bail is completely removed from the top of the stumps, or a stump is struck out of the ground".
